These terms of use (together with the documents referred to in it) (“terms”) sets out the terms and conditions that apply to your use any of our websites, including but not limited to:

(each a “Site”, and collectively the “Sites”).

Use of our Sites include accessing, browsing, registering for and using an account, or signing up for marketing communications.

Please read these terms carefully before you start to use our Sites, as these will apply to your use of our Sites. By using our Sites, you confirm that you accept these terms and that you agree to comply with them.

If you do not agree to these terms, you must not use our Sites.

Information about us

In these terms and conditions, “we” and “us” means Media MICE Pte Ltd.

Changes to these terms
1. We may modify these terms and conditions at any time by publishing the modified terms and conditions on our Sites. Any modifications shall take effect immediately after the modified terms have been posted on our Sites.
2. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated. Your continued use of our Sites constitutes your acknowledgement and acceptance of such changes.
3. Every time you wish to use our Sites, please check these terms to ensure you understand the terms that apply at that time.
Changes to our Sites
1. We reserve the right to change, modify, substitute or remove without notice any information on our Sites from time to time.
Access to our Sites
1. You agree to comply with any and all terms, guidelines, notices, policies, and instructions pertaining to the use and/or access of the Sites, as well as any amendments to the aforementioned, issued by us, from time to time.
2. You acknowledge and agree that to access and use certain services on the Sites (including but not limited to the signing up for the CAKE & PIE Expo (C&PE)), you will be required to register and additionally shall be bound to strictly comply with any other terms and conditions (where applicable) in addition to these terms.
3. The information provided by us on our Sites is not in any way an invitation or recommendation to buy any products or services featured and you should seek appropriate independent advice.
4. You may not adapt or circumvent the systems in place in connection with our Sites, nor access our Sites other than through normal operations.
Intellectual property
1. The copyright in the material contained in our Sites, together with the website design, text and graphics, and their selection and arrangement, and all software compilations, underlying source code and software (including applets) belongs to us or our licensors. All rights are reserved. None of this material may be reproduced or redistributed without our written permission.
2. The trademarks and logos displayed on our Sites are our property, the property of our subsidiaries and affiliates, or of third parties. You are not permitted to use them without our approval.
3. You must not use any part of the content on our Sites for commercial purposes without obtaining a license to do so from us or our licensors.
4. You shall retain ownership of all copyright in data you submit to our Sites. You grant us a world-wide exclusive, royalty-free, non-terminable license to use, copy, distribute, publish and transmit such data in any manner.
No reliance on information
1. The content on our Sites is provided for general information only. It is not intended to amount to advice on which you should rely. you acknowledge that any reliance on any materials or information provided on our Sites shall be at your sole risk. You should not act on data or information obtained through our Site without first independently verifying its contents.
2. Although we make reasonable efforts to update the information on our Sites, we make no representations, warranties or guarantees, whether express or implied, that the content on our Sites is accurate, complete or up-to-date.
Exclusions of liability
1. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
2. We use reasonable endeavors to ensure that the data on our Sites is accurate and to correct any errors or omissions as soon as practicable after being notified of them. We do not monitor, verify or endorse information submitted by third parties for posting on our Sites and you should be aware that such information may be inaccurate, incomplete or out of date. To the extent permitted by applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained on our Sites. We do not guarantee that our Sites will be fault free and do not accept liability for any errors or omissions.
3. Due to the nature of electronic transmission of data over the internet, any liability we may have for any losses or claims arising from an inability to access our Sites, or from any use of our Sites or reliance on the data transmitted using our Sites, is excluded to the fullest extent permissible by law.
4. In no event shall we be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with this agreement or use of our Sites save where such liability cannot be excluded by law.
Acceptable use
1. You may use our Sites only for lawful purposes. You may not use our Sites:
  1. in any way that breaches these terms;
  2. in any way that breaches any applicable local, national or international law or regulation;
  3. in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  4. for the purpose of harming or attempting to harm minors in any way;
  5. to send, knowingly receive, upload, download, use or re-use any material which is defamatory, obscene, offensive, hateful, inflammatory, sexually explicit, discriminatory, infringing any copyright, database right or trade mark, deceitful, in breach of any legal duty, threatening, misrepresenting your identity, promoting violence or illegal activity or giving the impression that it emanates from us;
  6. to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam); or
  7. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
2. You also agree:
  1. not to reproduce, duplicate, copy or re-sell any part of our Sites in contravention of the provisions of our terms; and
  2. not to access without authority, interfere with, damage or disrupt:
    1. any part of our Sites;
    2. any equipment or network on which our Sites is stored;
    3. any software used in the provision of our Sites; or
    4. any equipment or network or software owned or used by any third party.
  3. not to hack into, interfere with, disrupt, disable, over-burden or otherwise impair the proper working of our Sites, which shall include but is not limited to denial-of-service attacks, spoof attacks, session hacking, sniffing, tampering, reverse engineering or reprogramming; and,
  4. not to use the account of another person at any time, whether with or without his/her permission.
3. We reserve the right to remove any comments you make or content you upload to our Sites if, in our opinion, it does not comply with the above.
Data protection
1. We are committed to protecting your privacy. We will collect and use personal data supplied by you and other users of our Sites in accordance with our Privacy Notice.
Termination and suspension
1. We will endeavor to allow uninterrupted access to our Sites, but access to our Sites may be suspended, restricted or terminated at any time without notice and without assigning any reason.
2. Failure to comply with these terms, including but not limited to clause 8, may result in our taking of actions we reasonably deem appropriate, including any or all of the following actions:
  1. immediate, temporary or permanent withdrawal of your right to use our Sites;
  2. immediate, temporary or permanent removal of any posting or material uploaded by you to our Sites;
  3. issue of a warning to you;
  4. legal proceedings against you for reimbursement of all of our costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  5. further legal action against you; and/or
  6. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
3. All disclaimers, indemnities and exclusions in these terms and conditions shall survive termination of the agreement between us for any reason.
Viruses
1. We do not give any warranty that our Sites is free from viruses or anything else which may have a harmful effect on any technology. You are responsible for configuring your information technology, computer programs and platform in order to access our Sites.
Third Party Content; Links
1. We may provide you with third party content on our Sites, such as through the CP&E, which are either owned by us or licensed to us for our use (including but not limited to the content of all conference materials and presentations). You agree that we shall not be responsible or liable for your access or use of any third party content on our Sites. This includes but is not limited to any statements and content of speakers for and during the CP&E, and any content provided by sponsors of the CP&E.
2. We may also provide links to other websites as part of our Sites. You acknowledge that:
  1. we do not control such third party websites and are not responsible for their contents;
  2. we will not be party to any transaction or contract with a third party that you may enter into via such websites;
  3. we shall not be liable to you in respect of any loss or damage which you may suffer by using those websites; and
  4. you agree that you will not involve us in any dispute between you and the third party.
3. You may link to our Sites, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part unless we have given you our written permission.
General
1. A failure by us to exercise or enforce any rights conferred upon us by these terms shall not be deemed to be a waiver or variation of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.
2. If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.
3. A person who is not a party to these terms shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and the application of the Contracts (Rights of Third Parties) Act (Cap 53B) is expressly excluded.
Governing law
1. These terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. However, these terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.
2. You hereby agree to submit to the non-exclusive jurisdiction of the Singapore courts.
